Özet: Hukuka ilişkin kuramsal çalışmalarda Marksist yaklaşımın belirli yapısal kısıtları olduğu ön kabulünden yola çıkan bu makale; söz konusu kısıtlar içinde dahi, tamamen spekülatif olmayan analitik faydalar elde edilebileceğini saptar. Zira Marksizmin bugünün hukuk teorisine en somut eleştiriyi getirmesi olduğu kadar, kuramın öngördüğü gelecekte Marksist hukukçunun -burjuva hukukuna hâkimiyeti oranında- yeni topluma somut yapısal fayda sağlaması da mümkündür. Makale, bu saptamayı yapabilmek için Marksist hukuk çalışmalarını kuş bakışı gözden geçirirken hukuk kuramının bugününün temel sorunlarına da değinir.

Shall We ContInue Our Legal StudIes? A SystematIc Approach.

Abstract: Departing from the fact that marxism has certain structural limits when it comes to theoretical approaches to law; this article argues that even within those limits, some nonspeculative analytical benefits could be gained. For it is quite possible that marxist lawyer will be useful in the design of a new society as she is as a critique of contemporary law- only if she is competent in the field. The article , while describing the marxist legal theory from a bird’s eye view, comments on the vital problems of contemporary law to defend its argument.
